1. Acceptance of Terms

By accessing or using PolicyFlow by Fsuite (“PolicyFlow”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the platform.

2. Description of Services (Updated with Tier-Based Access)

PolicyFlow is an Insurance Growth Platform that provides a range of tools and services, which may include:

  • Lead generation tools
  • CRM and client management
  • Marketing automation (email, Messenger, and other supported channels)
  • Appointment booking systems
  • Sales training and educational resources
  • Chatbot and messaging automation powered by third-party providers (e.g., ManyChat)
  • Reporting and analytics

PolicyFlow does not provide insurance products, underwriting, or act as an insurer, broker, or licensed financial advisor.

Service Access by Subscription Tier

Access to specific features, tools, and services within PolicyFlow may vary depending on the subscription plan or tier selected by the user.

  • Certain features may be included, limited, or unavailable depending on the user’s subscription level.
  • PolicyFlow reserves the right to define, modify, or update the features included in each subscription tier at any time.
  • Users acknowledge that they may not have access to all features or services unless subscribed to the appropriate plan.

Any descriptions of features on marketing pages, sales materials, or demonstrations are for informational purposes only and do not guarantee availability unless included in the user’s active subscription plan.

3. Eligibility

You must:

  • Be at least 18 years old
  • Comply with all applicable insurance laws and regulations
  • Hold any required licenses to sell or offer insurance products

You are solely responsible for maintaining your professional licenses and regulatory compliance.

4. User Responsibilities

You agree to:

  • Use the platform only for lawful purposes
  • Provide accurate and truthful information
  • Maintain the confidentiality of your login credentials
  • Comply with all applicable data privacy, marketing, and insurance regulations

You are responsible for:

  • All communications sent to leads and clients
  • Reviewing and approving automated or chatbot-generated responses
  • Ensuring compliance with advertising and insurance laws
  • Proper collection, storage, and use of client data

5. No Guarantee of Results

PolicyFlow provides tools and systems designed to assist with:

  • Lead generation
  • Client management
  • Sales processes

However, we do not guarantee:

  • Number or quality of leads
  • Appointments booked
  • Policies sold
  • Income or financial results

Results vary based on user effort, experience, and market conditions.

6. Lead Generation Disclaimer

PolicyFlow may provide:

  • Lead generation tools
  • Marketing templates
  • Campaign systems

We do not guarantee the accuracy, quality, or conversion of leads.

Users are responsible for:

  • verifying lead information
  • complying with applicable marketing and consent laws

7. Communication & Messaging Compliance

You agree to comply with all applicable laws related to:

  • email marketing
  • Messenger and chat-based communication

Including:

  • obtaining proper consent
  • honoring opt-out or unsubscribe requests
  • complying with anti-spam and data protection regulations

PolicyFlow is not liable for misuse of communication tools.

8. Chatbot & Messaging Automation Disclaimer (Third-Party Integration)

PolicyFlow integrates with third-party chatbot and messaging platforms, including but not limited to ManyChat.

By using these features, you acknowledge and agree that:

  • chatbot and messaging services are provided by third-party platforms and are subject to their own terms and policies
  • PolicyFlow does not control or guarantee the availability, delivery, or performance of such services
  • automated responses may not always be accurate, complete, or appropriate
  • you are responsible for reviewing and monitoring all automated communications
  • you remain fully responsible for all interactions with leads and clients

PolicyFlow shall not be liable for:

  • message delivery failures or delays
  • account restrictions, suspensions, or bans imposed by third-party platforms
  • errors or inaccuracies in automated responses
  • any damages arising from reliance on chatbot-generated communications

9. Subscription & Payments

PolicyFlow operates on a subscription basis.

  • Fees may be billed monthly or annually
  • Payments are non-refundable unless otherwise stated
  • Failure to pay may result in account suspension or termination

We reserve the right to update pricing with prior notice.

10. Intellectual Property

All software, systems, content, and materials within PolicyFlow are owned by:

Funnel Suite Solutions Corp (Fsuite)

You may not:

  • copy, reproduce, or distribute the platform
  • resell or sublicense the system without authorization
  • reverse engineer or attempt to extract source code

11. Data & Privacy

PolicyFlow processes user and client data.

You agree to:

  • comply with the Data Privacy Act of 2012 (RA 10173) and other applicable laws
  • obtain proper consent from clients before collecting or processing personal data

PolicyFlow implements reasonable security measures but does not guarantee absolute data security.

12. Third-Party Integrations

PolicyFlow integrates with third-party services such as:

  • Facebook Ads
  • email service providers
  • messaging platforms (including ManyChat)

We are not responsible for:

  • service outages or interruptions
  • delivery failures or delays
  • account suspensions or restrictions
  • changes to third-party APIs, policies, or pricing

Your use of these services is subject to their respective terms.

13. Platform Dependency Disclaimer

PolicyFlow relies on third-party platforms to deliver certain features.

You acknowledge that:

  • functionality may be affected by third-party changes
  • uninterrupted access is not guaranteed
  • PolicyFlow is not liable for disruptions caused by external systems

14. Account Suspension & Termination

We reserve the right to suspend or terminate your account for:

  • violation of these Terms
  • illegal, fraudulent, or unethical use
  • misuse of automation or messaging systems

You may cancel your subscription at any time.

15. Limitation of Liability

To the fullest extent permitted by law:

PolicyFlow and Fsuite shall not be liable for:

  • lost profits or revenue
  • business interruptions
  • indirect, incidental, or consequential damages

Total liability shall not exceed the amount paid by you in the previous three (3) months.

16. Indemnification

You agree to indemnify and hold harmless:

from any claims arising from:

  • your use of the platform
  • violation of laws or regulations
  • client disputes
  • misuse of chatbot, automation, or marketing tools

17. Modifications to Terms

We reserve the right to modify these Terms at any time.

Continued use of PolicyFlow constitutes acceptance of updated Terms.
